1. About Amigo.Contact

Amigo.Contact is an online platform that provides access to AI-based Amigos, including Lifestyle Amigos and Personal Amigos, together with related website, onboarding, support, scheduling and account services.

Amigo.Contact may include:

  • ready-made Lifestyle Amigos focused on a specific subject or interest;
  • Personal Amigos created for an individual customer;
  • websites, portals and account functionality;
  • onboarding conversations and related support;
  • appointment scheduling and consultation requests;
  • usage tracking, billing and payment functionality;
  • customer support and communication services.

The exact features available to you may depend on the Amigo, product, plan or service you use.

2. Acceptance and changes to these Terms

By using Amigo.Contact, you agree to comply with these Terms of Use, our Privacy Policy and any other policies or conditions clearly referred to during your use of the services.

We may update these Terms of Use from time to time. When a change is material, we will take reasonable steps to inform you where required by law. The updated version will become effective on the date stated in the revised Terms of Use.

If you continue to use Amigo.Contact after the updated Terms become effective, this may constitute acceptance of the changes where permitted by applicable law. If you do not agree with a material change, you should stop using the affected service and contact us if necessary.

  • circumvent usage limits, access restrictions, security measures or payment controls;
  • use automated systems to extract or overload the service without written permission;
  • use an Amigo to make high-risk decisions without appropriate human or professional verification;
  • use information from an Amigo as a substitute for qualified professional advice where such advice is required.

4.1 Misuse of AI Amigos

Our Amigos are designed to provide useful conversation, information, ideas and general guidance. You must not deliberately misuse them to:

  • create content intended to facilitate unlawful activity;
  • obtain instructions for harming people, property or systems;
  • create deceptive impersonations, harmful deepfakes or targeted disinformation;
  • manipulate, exploit or interfere with the operation of the AI system;
  • extract confidential system instructions or security information;
  • present AI-generated content as verified professional, official or human-authored advice when it is not.

5. Nature and limitations of AI services

Amigo.Contact uses artificial intelligence to generate responses. AI-generated content may contain mistakes, omissions, outdated information or misunderstandings of your question.

An Amigo may not always:

  • understand your meaning or context correctly;
  • provide complete or accurate information;
  • recognise every relevant risk or exception;
  • reflect the latest prices, laws, product details or availability;
  • produce advice that is suitable for your personal circumstances.

You are responsible for reviewing important information and using your own judgement before acting on an AI-generated response.

Amigos do not replace qualified professional advice, including medical, psychological, legal, financial, tax, nutritional, fitness, technical or other regulated advice.

If a situation involves an emergency, serious health concern, danger, suspected abuse, legal risk or another urgent matter, contact the appropriate emergency service or qualified professional instead of relying on an Amigo.

6. Lifestyle Amigos and Personal Amigos

6.1 Lifestyle Amigos

A Lifestyle Amigo is a predefined AI agent focused on a particular subject or interest. Lifestyle Amigos are designed for general use and may offer limited personalisation based on the information you provide during a conversation.

A Lifestyle Amigo does not create a professional relationship with you and should not be treated as a substitute for a qualified specialist.

6.2 Personal Amigos

A Personal Amigo is an AI agent created around the preferences, goals, communication style and relevant context of one individual customer.

Personalisation does not guarantee that every response will be accurate, appropriate or suitable for a particular decision. You remain responsible for reviewing important information and deciding how to act on it.

Additional conditions may apply to the creation, onboarding, maintenance and use of a Personal Amigo. Those conditions will be communicated before the relevant service begins.

7. Intellectual property

7.1 Amigo.Contact content and technology

Unless stated otherwise, Amigo.Contact and its licensors own or control the rights in the website, portal, software, platform, design, branding, logos, text, graphics, images, videos, AI Amigo identities, prompts, workflows and underlying technology.

You may use this material only as part of your authorised use of Amigo.Contact. You must not copy, reproduce, republish, distribute, sell, license, modify, publicly display or create derivative works from it without our prior written permission, unless permitted by law.

7.2 Your content

You retain ownership of content that you create, upload or submit through Amigo.Contact, subject to the rights of third parties and applicable law. This may include profile information, preferences, goals, questions, instructions and conversation content.

You grant Amigo.Contact a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt and display your content only to the extent reasonably necessary to:

  • provide and operate the services;
  • maintain, secure and support the platform;
  • respond to support requests;
  • prevent misuse, fraud and security incidents;
  • comply with legal obligations;
  • improve the services in accordance with our Privacy Policy.

This licence ends when the relevant use of your content is no longer necessary, except where we are required or permitted by law to retain certain information, or where the content has been irreversibly anonymised or aggregated.

You confirm that you have the necessary rights and permissions to submit the content and that doing so does not unlawfully infringe the rights of another person or organisation.

8. Privacy and personal data

Your use of Amigo.Contact is also governed by our Privacy Policy.

The Privacy Policy explains, among other things:

  • which personal data we collect;
  • why and how we process personal data;
  • how information may be shared with service providers;
  • how long information may be retained;
  • how you can exercise your privacy rights;
  • how we handle security, deletion and data requests.

These Terms of Use do not replace the Privacy Policy. Where data-protection law requires a separate legal basis, consent or other user action, that requirement applies independently.

Please do not submit passwords, payment credentials, identity-document numbers, confidential third-party information or other sensitive information unless it is necessary for the relevant service and you are authorised to provide it.

9. Pricing, payments and usage

9.1 Prices and fees

Prices and applicable fees are shown on the relevant website page, order screen or service proposal. The applicable price is the price presented to you before you confirm a purchase, unless an obvious pricing error is present.

The current Personal Amigo setup model includes a one-time setup fee of €149. There is no monthly subscription for this setup model. Usage is charged separately according to the applicable usage rates.

Lifestyle Amigos may include a limited number of free messages or another introductory offer. After the applicable free allowance, usage charges may apply as shown on the relevant product or pricing page.

We may change future prices or usage rates. Any price change will not affect an order that you have already confirmed, unless otherwise permitted by law or agreed with you.

9.2 Payment processing

Payments may be processed by an external payment provider. By submitting payment information, you authorise the payment provider to process the applicable charge according to the information shown at checkout or in your service agreement.

You agree to:

  • provide accurate and current payment information;
  • ensure that you are authorised to use the selected payment method;
  • pay the charges properly incurred through your account;
  • inform us or the payment provider when relevant payment information changes.

We do not normally receive or store complete payment-card details. Payment information is handled in accordance with the applicable payment provider’s terms and privacy information.

9.3 Refunds and statutory rights

Refunds are handled according to applicable law, the conditions shown at the time of purchase and any specific service agreement.

Nothing in these Terms of Use limits mandatory consumer rights, including rights that cannot legally be excluded or waived.

Where a service is delivered digitally and you ask for it to begin immediately, applicable law may affect your right to cancel or receive a refund after delivery has started. Any required information or consent will be provided during the purchase or onboarding process.

10. Availability and service changes

We aim to keep Amigo.Contact available and reliable, but we cannot guarantee uninterrupted access.

The service may occasionally be unavailable or limited because of:

  • maintenance, updates or technical changes;

  • security incidents or measures;
  • internet, hosting or telecommunications problems;
  • events beyond our reasonable control.

We may update, modify, suspend or discontinue parts of the platform or an Amigo. Where required by law, we will provide appropriate notice and assistance.

Amigo.Contact may use or link to third-party services, including payment providers, scheduling tools, hosting providers, AI technology providers and external websites.

Third-party services may have their own terms, privacy policies and technical limitations. We do not control third-party services and are not responsible for their independent content, availability, security, privacy practices or terms.

You should review the applicable third-party information before using an external service or submitting information through it.

12. Disclaimer of warranties

To the maximum extent permitted by applicable law, Amigo.Contact is provided on an “as is” and “as available” basis.

We do not guarantee that:

  • the website or services will always be available;
  • the services will be error-free, secure or uninterrupted;
  • AI-generated information will always be accurate, complete or current;
  • an Amigo will meet every personal expectation or objective;
  • all defects or technical problems will be corrected immediately;
  • the service will be suitable for every individual situation.

Nothing in these Terms of Use excludes or limits a warranty, guarantee or statutory right that cannot legally be excluded or limited.

13. Limitation of liability

To the maximum extent permitted by applicable law, Amigo.Contact will not be liable for indirect, incidental, special or consequential loss arising from or connected with:

  • your use of or inability to use the services;
  • temporary interruption, delay or unavailability;
  • loss or corruption of data;
  • reliance on AI-generated information;
  • decisions made on the basis of an Amigo’s response;
  • third-party services, content or conduct;
  • unauthorised access caused by your failure to protect your account.

Where liability cannot legally be excluded, our liability will be limited to the direct loss that was reasonably foreseeable and legally attributable to us.

Unless a different mandatory limit applies, our total liability for a claim relating to the services will not exceed the amount you paid to Amigo.Contact for the relevant service during the 12 months before the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited, including liability for intentional wrongdoing, fraud or other matters protected by mandatory law.

14. Your responsibility and indemnification

You are responsible for your use of Amigo.Contact and for the content you submit.

To the extent permitted by applicable law, you agree to compensate Amigo.Contact for reasonable losses, claims, liabilities and costs resulting from:

  • your material breach of these Terms of Use;
  • your unlawful use of the services;
  • content that you submit without the necessary rights or permissions;
  • your infringement of another person’s rights;
  • your deliberate misuse of the platform or an Amigo.

This provision does not require you to compensate us for losses caused by our own unlawful conduct or negligence where such compensation cannot legally be required.

15. Ending your use of the services

15.1 Ending your account

You may stop using Amigo.Contact at any time. If you have an account, you may request closure or deletion through the available account functionality or by contacting us through the contact form.

Ending your account does not automatically cancel charges that have already become due. Data deletion and retention are handled according to our Privacy Policy and applicable law.

15.2 Ending or restricting access

We may suspend or end your access where reasonably necessary because of a serious or repeated breach of these Terms, unlawful use, security risks, non-payment or a legal requirement.

Where appropriate and legally permitted, we will provide notice and explain the reason for the restriction.

16. Complaints and dispute resolution

These Terms of Use, together with the Privacy Policy and any other conditions expressly referred to during the purchase or use of a service, form the agreement between you and Amigo.Contact concerning the relevant services.

17.2 Severability

If a provision of these Terms is found to be invalid or unenforceable, it will be modified or interpreted to the minimum extent necessary to make it enforceable. The remaining provisions will remain in effect.

17.3 No waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

17.4 Assignment

You may not transfer your rights or obligations under these Terms without our prior written permission, unless permitted by applicable law.
